1. Acceptance
These Terms of Service ("Terms") govern your access to and use of the 448 mobile application and the website at 448datingapp.com (together, "the Service"). The Service is provided by 448, Inc. ("448," "we," "us"). By creating an account or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
To use 448, you must:
- Be at least 18 years old.
- Be legally able to enter into a binding contract under the laws of your jurisdiction.
- Not be barred from using the Service under U.S. law or the laws of any jurisdiction where you reside.
- Not have previously had your 448 account terminated for a violation of these Terms.
3. Your account
You are responsible for maintaining the security of your account, including your phone number, sign-in methods, and any linked Apple or Google accounts. You agree to provide truthful information in your profile and not to impersonate anyone else. We may suspend or terminate accounts that contain false information, including fake names, fake photos, or misrepresented health status.
4. Your content
You own the content you post on 448 — your photos, profile fields, conversations, and community posts ("Your Content"). By posting Your Content, you grant 448 a worldwide, non-exclusive, royalty-free license to host, store, display, and transmit Your Content solely for the purpose of operating the Service. This license ends when you delete Your Content or your account, except where retention is required by law or necessary to resolve disputes.
You promise that you own (or have the right to use) all of Your Content and that none of it infringes the rights of any other person.
5. Acceptable use
You agree not to:
- Use 448 if you are under 18.
- Misrepresent your HIV status, treatment status, or any other health information in your profile or in conversations with other members.
- Stalk, harass, threaten, or intimidate any other user.
- Use 448 for any commercial solicitation — including sex work, escorting, recruiting for another platform, or selling products or services.
- Share nudity or sexually explicit imagery in profile photos. Private, consensual conversations between matched adults are subject to community guidelines.
- Post content that incites violence; promotes hatred against a protected class; or attacks people for their HIV status, race, gender, sexual orientation, gender identity, religion, or disability.
- Out another user's HIV status, identity, or any private information they shared with you.
- Scrape, copy, or otherwise systematically extract data or content from the Service.
- Reverse engineer, decompile, or attempt to derive source code from any part of the Service.
- Use bots, automation, or any non-human means to interact with the Service.
- Use the Service in any way that violates applicable law.
6. Verification and safety
448 uses on-device face verification to confirm that the person creating an account matches their profile photos. Verification is one safety signal, not a guarantee. We use a combination of automated and human moderation, and we rely on you to report behavior that violates these Terms — every report is reviewed by a person.
We may remove content, suspend or terminate accounts, and take other actions we believe are necessary to keep the community safe, including based on a single serious violation.
7. Disclosure and HIV status
448 is a community for people living with HIV and their allies. It is not a medical service, a healthcare provider, or a substitute for professional medical advice. Information about HIV, U=U (Undetectable = Untransmittable), PrEP, or any other health topic on 448 is for general educational purposes only. It does not constitute medical advice, diagnosis, or treatment. Always consult a licensed healthcare provider before making decisions about your health.
Sharing your HIV status on 448 is voluntary and lawful in the jurisdictions where the Service is available. Some U.S. states still criminalize non-disclosure of HIV status to sexual partners. You are responsible for understanding the law in your jurisdiction. 448 does not provide legal advice.
8. Subscriptions and payment
448 is a paid service. To use 448 after completing onboarding, you must purchase a 448 Pro subscription. There is no free tier or ad-supported tier. We charge upfront so we do not have to monetize your attention, sell your data, or run advertising against your matches.
448 Pro is offered as a recurring auto-renewing subscription, billed monthly or annually depending on the plan you select. Exact pricing, the length of any introductory offer, and renewal dates are shown in the app at the point of purchase.
Billing
- Subscriptions are processed by Apple via the App Store. Payment is charged to your Apple ID when you confirm purchase.
- Subscriptions automatically renew at the end of each billing cycle unless you cancel at least 24 hours before the renewal date.
- You can manage and cancel your subscription at any time at Apple Subscriptions.
- Introductory offers, if offered, convert to paid subscriptions at the end of the introductory period unless you cancel before it ends.
Refunds
Apple and Google administer refunds for in-app subscriptions according to their own policies. 448 does not process refunds directly for App Store or Google Play purchases. To request a refund, contact Apple or Google.
9. Termination
You can delete your account at any time in Settings → Logout / Delete account. We may suspend or terminate your access immediately, without notice, if you violate these Terms, threaten the safety of other members, or use the Service in a manner that exposes 448 to legal liability.
On termination, the licenses you've granted to 448 end (except as described in Section 4), and your access to paid features ends. We do not refund unused subscription time when an account is terminated for cause.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by law, 448 disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.
448 does not warrant that the Service will be uninterrupted, secure, error-free, or that any introduction will result in a connection, friendship, or relationship. We do not control and are not responsible for the conduct, statements, or behavior of any other user, online or offline.
11. Limitation of liability
To the maximum extent permitted by law, 448, Inc., its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Service.
448's total liability for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid 448 in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).
12. Indemnification
You agree to defend, indemnify, and hold harmless 448, Inc. and its officers, employees, and contractors from any claim, demand, loss, or expense (including reasonable attorney's fees) arising out of your violation of these Terms, your misuse of the Service, or your violation of any law or the rights of another person.
13. Dispute resolution and arbitration
Any dispute arising out of these Terms or your use of the Service will be resolved by binding arbitration administered by [arbitration provider — to be selected with counsel] under its consumer rules, on an individual basis. You waive any right to a jury trial or to participate in a class action. This provision is governed by the Federal Arbitration Act and the laws of the State of [state — to be selected].
Right to opt out: you may opt out of this arbitration provision within 30 days of first accepting these Terms by emailing info@448datingapp.com with the subject "Arbitration opt-out." Opting out will not affect any other provision of these Terms.
14. Governing law
These Terms are governed by the laws of the State of [state — to be selected with counsel], United States, without regard to its conflict of laws principles. Where applicable consumer protection law in your country of residence provides greater protections, those provisions apply.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in the app and via email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
16. Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full effect.
